1. ACKNOWLEDGMENT OF RISKS
I understand that gymnastics and related activities involve inherent risks, including but not limited to: falls, collisions with equipment or other participants, sprains, fractures, head injuries, and in rare cases, serious injury or death. I acknowledge that these risks cannot be completely eliminated even with reasonable care.
2. ASSUMPTION OF RISK
I voluntarily assume all risks of injury, damage, or loss that may result from participation in gymnastics activities at Volusia Mobile Gymnastics, LLC, whether such risks are known or unknown.
3. WAIVER & RELEASE OF LIABILITY
In consideration of being allowed to participate in gymnastics activities at Volusia Mobile Gymnastics, LLC, I, on behalf of myself (and, if applicable, my minor child), hereby release, waive, discharge, and hold harmless Volusia Mobile Gymnastics, LLC, its owners, members, managers, employees, contractors, and agents from any and all claims, demands, or causes of action arising out of or related to participation in such activities, EXCEPT for claims arising from gross negligence or intentional misconduct.
4. INDEMNIFICATION
I further agree to indemnify and hold harmless Volusia Mobile Gymnastics, LLC from any loss, liability, damage, or cost, including attorneys' fees, that may arise from my or my minor child's participation in these activities, except to the extent caused by gross negligence or intentional misconduct.
5. MEDICAL AUTHORIZATION
I authorize Volusia Mobile Gymnastics, LLC to obtain emergency medical care if deemed necessary and agree to be financially responsible for any costs incurred.
6. NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF VOLUSIA MOBILE GYMNASTICS, LLC USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM, YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM VOLUSIA MOBILE GYMNASTICS, LLC IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND VOLUSIA MOBILE GYMNASTICS, LLC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
7. SEVERABILITY
If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
8. ACKNOWLEDGMENT & UNDERSTANDING
By signing below, I acknowledge that I have carefully read this agreement, fully understand its terms, and sign it voluntarily. I understand that I am giving up substantial legal rights.
